Европу озадачили «актом Жанаозена»

Граж­дан­ские акти­ви­сты из Казах­ста­на, по при­ме­ру «спис­ка Маг­нит­ско­го», соста­ви­ли спи­сок чинов­ни­ков, назвав его «спис­ком Жана­о­зе­на». В кон­це про­шлой неде­ли он был вру­чен депу­та­там Евро­пей­ско­го пар­ла­мен­та как при­ло­же­ние к откры­то­му пись­му с прось­бой о под­держ­ке ини­ци­а­ти­вы и рас­спро­стра­нен в Брюс­се­ле сре­ди жур­на­ли­стов и пра­во­за­щит­ных организаций.

Адре­со­ва­но пись­мо пре­зи­ден­там Евро­пей­ско­го пар­ла­мен­та и Евро­пей­ской комис­сии, Спе­ци­аль­но­му пред­ста­ви­те­лю Евро­пей­ско­го Сою­за по Цен­траль­ной Азии, а так­же Упол­но­мо­чен­но­му по пра­вам чело­ве­ка при ЕС.

Его под­пи­сан­ты — глав­ный редак­тор казах­стан­ской газе­ты «Взгляд» Игорь Виняв­ский и шеф-редак­тор медиа-груп­пы «Рес­пуб­ли­ка» Ири­на Пет­ру­шо­ва — обра­ти­лись к евро­пей­ским поли­ти­кам и чинов­ни­кам с прось­бой  ини­ци­и­ро­вать «акт Жана­о­зе­на» — доку­мент, с помо­щью кото­ро­го мож­но при­звать к отве­ту казах­стан­ских чинов­ни­ков, пря­мо или кос­вен­но име­ю­щих отно­ше­ние к кро­ва­вой тра­ге­дии, слу­чив­шей­ся 16 декаб­ря 2011 года в казах­стан­ском горо­де Жана­о­зене, и поли­ти­че­ским репрес­си­ям в отно­ше­нии акти­ви­стов оппо­зи­ции и жур­на­ли­стов неза­ви­си­мых средств мас­со­вой информации.

«Наши попыт­ки оста­но­вить про­из­вол и поли­ти­че­ские репрес­сии ока­зы­ва­ют­ся бес­по­лез­ны­ми, так как все­го госу­дар­ствен­ные орга­ны, вклю­чая про­ку­ра­ту­ру и суд, нахо­дят­ся под кон­тро­лем Назар­ба­е­ва и выпол­ня­ют его ука­за­ния.  Он же не дает согла­сия на про­ве­де­ние меж­ду­на­род­но­го рас­сле­до­ва­ния, так как пони­ма­ет к каким выво­дам оно при­дет.  В этих усло­ви­ях мы обра­ща­ем­ся к Евро­пей­ско­му сою­зу за помо­щью. Мы уве­ре­ны, что если Евро­пей­ский союз по при­ме­ру «акта Маг­нит­ско­го» при­мет «Акт Жана­о­зе­на» то Назар­ба­ев не осме­лит­ся про­дол­жать свои репрес­сии», — гово­рит­ся в откры­том пись­ме журналистов.

Ини­ци­а­то­ры «акта Жана­о­зе­на» про­сят помочь добить­ся запре­та на  въезд на тер­ри­то­рии евро­пей­ских стран фигу­ран­там «спис­ка Жана­о­зе­на», а так­же лишить их воз­мож­но­сти дер­жать свои акти­вы  в Евро­пе.  Они счи­та­ют, что  эти меры ока­жут­ся весь­ма болез­нен­ны­ми для казах­стан­ских чинов­ни­ков и заста­вят их заду­мать­ся над сво­и­ми действиями.

- Мы уже нача­ли состав­лять  спи­сок «Жана­о­зе­на», — про­ком­мен­ти­ро­ва­ла ини­ци­а­ти­ву Ири­на Пет­ру­шо­ва. —  Сей­час  он, конеч­но же, дале­ко не пол­ный. Я думаю, что в фор­ми­ро­ва­нии «жана­о­зен­ско­го листа» при­мут уча­стие и наши кол­ле­ги из дру­гих изда­ний, и поли­ти­ки, и акти­ви­сты граж­дан­ско­го общества.

- Реак­ция на нашу ини­ци­а­ти­ву уже есть, при­чем поло­жи­тель­ная, — рас­ска­зал в свою оче­редь Игорь Виняв­ский. — У депу­та­тов Евро­пей­ско­го пар­ла­мен­та нет иллю­зий в отно­ше­нии  ситу­а­ции в Казахстане.

Dear Sir/Madam,

On the 16th of December, 2011 a terrible tragedy happened in our country: the police shot on civilians in the small town of Zhanaozen in Western Kazakhstan. According to solely official data, 16 people were killed and approx. 100 were injured. This way, the seven-month conflict between government agencies, who supported employers, and workers of oil and gas companies that firmly and consistently defended their social rights, in spite of arrests and intimidation, beatings and even killings of protesters and their relatives, finally came to an end.

This tragedy became the starting point of a new era in the history of Kazakhstan. After this event, the country faced the wave of political oppression. The striking oil workers were unjustifiably convicted and sentenced to long-term inprisonment. Now, the trial of those who had helped the workers — civil society activists and politicians — is ongoing.  The authorities have been making attempts to shift the blame for the tragedy on to them. The next to be tried are workers of independent media — journalists are facing charges of participation in a coup. At the same time, those who shot on civilians and those who had ignored workers’ demands for seven months, were not identified or punished.

We are concerned about the future of our country and we fear for our colleagues in Kazakhstan. Our attempts to stop the tyranny and political oppression have been futile, since all public authorities, including prosecutors and the court, are under the control of Nazarbayev and they fulfill his orders. He does not consent to an international investigation, because he perfectly understands what conclusions it would bring to.

In these circumstances, we hereby address the European institutions with a request for help. Thanks to the intervention of the European politicians, activist of the labour union movement Natalia Sokolova, as well as civil society activists: Igor Vinyavskiy, Bulat Atabayev and Zhanbolat Mamay have already been released. We are confident that, if the European Union, following the example of the ‘Magnitsky Act’, adopts the ‘Zhanaozen Act’, Nazarbayev will not dare to continue the oppression.

We have prepared a suggested version of the ‘Zhanaozen List’. In this document, we included Kazakh officials, police officers, judges, security service workers, all directly or indirectly related to the Zhanaozen tragedy and the subsequent oppression of civil society activists and journalists.

 

We hereby request that the European Parliament and the European Commission consider adopting a document that will make the Nazarbayev’s regime respect the rights and freedoms of citizens and stop political oppression. We believe that the threat of a ban on entry into the territory of the European countries of those included in the ‘Zhanaozen List’, as well as depriving them of a possibility to keep their assets in Europe, will strongly sober down Kazakhstani authorities.

Talgat Musakhanov, Deputy Chief of the Department of Internal Affairs of the Mangistau Region, police colonel. He commanded the headquarters of the police response to the actions of the strikers in Zhanaozen and was a head of posse in the shooting of civilians.

Ири­на Пет­ру­шо­ва  шеф-редак­тор медиа-груп­пы «Рес­пуб­ли­ка», куда вхо­дят еже­не­дель­ная газе­та «Голос рес­пуб­ли­ки» и еже­днев­ный пор­тал «Рес­пуб­ли­ка», уже десять лет нахо­дит­ся за пре­де­ла­ми Казах­ста­на и управ­ля­ет изда­тель­ством дистан­ци­он­но. Поки­нуть стра­ну ее выну­ди­ли спец­служ­бы, инспи­ри­ро­вав про­тив нее несколь­ко уго­лов­ных дел. За десять лет вла­сти Казах­ста­на неод­но­крат­но пыта­лись закрыть газе­ту, ока­зы­ва­ли дав­ле­ние на жур­на­ли­стов, орга­ни­зо­вы­ва­ли финан­со­вые про­вер­ки и судеб­ные иски. Одна­ко газе­те посто­ян­но уда­ва­лось выдер­жи­вать ата­ки и оста­вать­ся медиа-пло­щад­кой для тех, кто не согла­сен с офи­ци­аль­ной поли­ти­кой авто­ри­тар­но­го Казахстана.

Игорь Виняв­ский  уже пять лет руко­во­дит газе­той «Взгляд», кото­рая, как и «Рес­пуб­ли­ка», неод­но­крат­но под­вер­га­лась  пре­сле­до­ва­нию со сто­ро­ны спец­служб и вла­стей. В янва­ре это­го года Игорь Виняв­ский был аре­сто­ван Коми­те­том наци­о­наль­ной без­опас­но­сти,  ему было предъ­яв­ле­но обви­не­ние в при­зы­вах к свер­же­нию вла­сти. Толь­ко под дав­ле­ни­ем Евро­пей­ско­го пар­ла­мен­та и кам­па­нии, раз­вер­нув­шей­ся за осво­бож­де­ние жур­на­ли­ста внут­ри стра­ны, поз­во­ли­ли ему вый­ти на сво­бо­ду, избе­жав дли­тель­но­го тюрем­но­го заключения.
